This BSR is a critical examination of the judicial appointments process, as witnessed in the public interviews of candidates for the Constitutional Court this week. This is an important process which defines the composition of the third arm of the state. One of the major changes introduced by the Constitution, which was adopted in 2013 was a new process of judicial appointments.

Previously, judges were appointed by the President after consultation with the Judicial Service Commission (JSC). The President had no obligation to follow the advice of the JSC. He only had to consult it but could ignore its advice.
