Liliana Eskenazi of Allen & Overy LLP, Paris, discusses regulated gas prices with reference to the opinion of Advocate General Paolo Mengozzi (CJEU) in case C-121/15 ANODE on the regulated gas price mechanism in France, which marked a significant precedent for national regulation of prices. The case addresses two delicate and seemingly conflicting issues; the opening of national markets to comply with Directive 2009/73/EC to achieve an internal gas market in the EU and the requirements of public service in the general economic interest which allows Member States to intervene to fix prices.
