Today on Hull and Hull on Estates, Paul Trudelle and Holly LeValliant discuss an application for a preservation order by the Attorney General of Ontario to try to stop a mentally ill man who killed his wife from receiving her life insurance proceeds.
Ved Dhingra was found Not Criminally Responsible for her death as a result of his mental illness.  The Ontario Superior Court of Justice allowed the preservation order and the Attorney General applied for forfeiture of the insurance proceeds under the Civil Remedies Act.  Ontario (Attorney General) v. $51,000 CDN (in rem), 2012 ONSC 4958 (CanLII).
