Working on a cancer malpractice suit provides special challenges for legal nurse consultants. As in all potential legal cases, attorneys come to LNCs for their expertise, and that requires special attention to discerning in which of several possible areas the error occurred. It also means being able to assign responsibility among a host of medical practitioners for the responsibility.



Susan Haibeck, an experienced LNC, shares her extensive knowledge derived from working in such cases. She emphasizes the need for receiving from attorneys all available information about the case, also the negative impact on a case when vital data has disappeared, the role of equipment malfunctions in assignment of error, and the importance of timing in diagnosis as a factor in standard of care.She speaks about the especially poignant experience of working with children with cancer and offers hope that cures for many kinds of pediatric cancer have emerged. In addition, she and interviewer Pat Iyer, discuss cases which are prosecuted as fraud rather than malpractice. Susan cites a case in Michigan involving 450 lawsuits.
