The Vermont office of the ACLU is suing a state trooper on behalf of a man who was arrested for "flipping off" a police officer. The driver in question was pulled over, detained, and questioned by a state trooper. When released the ticked off man proceeded to give the officer the middle finger salute. The disorderly conduct charge was eventually dismissed but the man is now suing for First Amendment violations. Does the Vermont man have a good case?
