The Privacy Commissioner fears a public backlash from making people scan in or keep a record of where they go may outweigh any benefits.
The Government says making record keeping mandatory at all alert levels at "busy places and events" will enable much quicker contact tracing.
Privacy Commissioner John Edwards says the policy risks undermining public goodwill and the Government is "rolling the dice" on it.
He spoke to Susie Ferguson.
