"An Act to Establish the Judicial Courts of the United States,"is critical for many reasons particularly in light of the fact of how abnormally powerful the federal courts have become in usurping the authority of Congress in so many areas. One of the major elements of this and related laws including Article VI to the Constitution was to prohibit what is referred to as a ‘Religious Test’ for someone running for and holding public office. Why was this prohibition put into place and what does it really mean? What is meant by the phrase, “Religious Test”? Is there a difference between what the Federal and State Constitutions say about this? How is it that certain elected officials and others in culture are creating “De-Facto Religious Tests” today for those being nominated to serve in public office?
