The laws surrounding employee and independent contractor (IC) classification and compliance in California are complex. It’s an area fraught with risks so it's really important that you understand the potential risks that come with bringing in additional workers before you take that leap. 

 

In this episode, learn some things you need to know when it comes to classifying and hiring independent contractors in California. If you're unsure, it is best to err on the side of treating a worker as an employee, then from there, you can see if they fit into the independent contractor classification based on the tests we will be discussing today.

 

However, the risk can be very high and it’s complicated to figure out proper classifications. Therefore, if you really want to make sure to stay compliant, it’s best to be working with an employment attorney even before you hire your first employees and contractors to just mitigate that risk of hiring anyone. And don't just think this only applies to early-stage companies because a lot of more mature companies still end up misclassifying employees as independent contractors.
